Section 01

Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Client," "you," or "your") and AClean ("AClean," "we," "us," or "our"), a company operating in Chilliwack, British Columbia, Canada.

By requesting a quote, booking a service, permitting AClean personnel to access your property, making a payment, or using our website at goaclean.com, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not engage our services.

If you are booking services on behalf of a company, strata, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms.

Services Provided

AClean provides professional exterior cleaning services for residential and commercial properties in the Fraser Valley, British Columbia, including but not limited to:

The specific services to be performed, the scope of work, and the agreed price are as set out in the written or verbal quote accepted by you prior to service commencement. AClean reserves the right to decline any service request at its sole discretion.

All quotes provided by AClean — whether by phone, email, website form, or in person — are free of charge and subject to the following conditions:

Scheduling & Cancellations

4.1 Booking Confirmation. Your appointment is confirmed once AClean has acknowledged your booking by telephone, email, or text message. You will receive a reminder within 24 hours of your scheduled service date.

4.2 Cancellation by Client. You may cancel or reschedule a confirmed appointment at no charge provided you give at least 24 hours' notice prior to the scheduled start time. Cancellations made with less than 24 hours' notice may be subject to a cancellation fee of up to $75.00 CAD to cover mobilization costs. Repeat last-minute cancellations may result in AClean declining future bookings.

4.3 Weather & Postponement. AClean reserves the right to postpone or reschedule services due to unsafe weather conditions (including rain, high winds, frost, lightning, or extreme temperatures) at any time before or during service delivery, without liability. In such cases, AClean will contact you promptly and reschedule at the earliest mutually convenient date. No cancellation fee applies to postponements initiated by AClean.

4.4 No-Access. If AClean technicians arrive at your property at the scheduled time and are unable to access the site due to a locked gate, animals, absent occupants, or other Client-controlled factors, a $75.00 CAD no-access fee may be charged to cover travel and time costs. AClean will make reasonable efforts to contact you before leaving the site.

4.5 Cancellation by AClean. AClean reserves the right to cancel a confirmed booking at any time. If AClean cancels, you will receive a full refund of any deposit paid. AClean will make reasonable efforts to reschedule at your convenience.

Section 05

Payment Terms

5.1 Due Date. Payment for all services is due in full upon completion of the work, unless alternative payment terms have been agreed in writing in advance (e.g., for commercial accounts or recurring service contracts).

5.2 Accepted Payment Methods. AClean currently accepts payment by cash, e-Transfer (Interac), and major credit cards. Payment method details will be confirmed at the time of booking.

5.3 Deposits. AClean may, at its discretion, require a deposit of up to 50% of the quoted price for large commercial projects or first-time residential bookings over $500.00 CAD. Deposits are non-refundable in the event of a Client-initiated cancellation with less than 24 hours' notice.

5.4 Overdue Accounts. Invoices not paid within fourteen (14) calendar days of the due date will bear interest at the rate of 2% per month (24% per annum), calculated and compounded monthly from the due date until paid in full. AClean reserves the right to suspend future services and to refer overdue accounts to a collections agency. All reasonable costs of collection, including legal fees on a solicitor-and-own-client basis, are the responsibility of the Client.

5.5 Disputed Invoices. If you dispute any portion of an invoice, you must notify AClean in writing within five (5) business days of receipt. Undisputed amounts remain due and payable by the original due date.

5.6 GST/HST. All quoted and invoiced amounts are exclusive of applicable goods and services tax (GST) unless expressly stated otherwise. GST will be added to all invoices at the applicable rate.

Client Responsibilities

To enable AClean to perform services safely and effectively, you agree to the following prior to and during service delivery:

Failure to fulfill these responsibilities may result in postponement of service, additional charges, or reduced liability on the part of AClean for any resulting damage or incomplete work.

Section 07

Property Access & Safety

7.1 Authorization. By booking a service, you represent that you are the property owner or an authorized agent of the property owner, and that you have authority to grant AClean access to the property for the purpose of performing the agreed services.

7.2 Hazardous Conditions. AClean technicians may, in their sole professional judgment, decline to perform or continue services if they identify conditions that pose an unreasonable risk to personal safety or to the property (including but not limited to structurally unsound gutters, severely deteriorated siding, unstable surfaces, or the presence of biohazards). AClean will notify you promptly in such cases. No charge will apply for work not performed due to safety concerns.

7.3 Ladders & Equipment. AClean may use ladders, water-fed poles, pressure washing equipment, and other tools on your property as necessary to perform the agreed services. You consent to reasonable equipment placement and agree to ensure surfaces on which ladders will be placed are reasonably stable and free from hidden hazards.

7.4 WorkSafeBC. AClean is registered with WorkSafeBC and maintains current coverage for all field personnel. You are not required to provide any form of workplace compensation for our employees.

Section 08

Satisfaction Guarantee

AClean stands behind the quality of every job. If you are not satisfied with the results of any service, you must notify us within 48 hours of service completion by telephone or email. We will return to the property at no additional charge to address any legitimate deficiency in our workmanship.

Section 09

Limitation of Liability

To the fullest extent permitted by applicable law, ACLEAN's total liability to you for any claim arising out of or in connection with the provision of services — whether in contract, tort (including negligence), or otherwise — shall not exceed the total amount paid by you to AClean for the specific service giving rise to the claim.

AClean shall not be liable for:

Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraudulent misrepresentation, or any other liability that cannot lawfully be limited under British Columbia law.

Section 10

Property Damage Claims

AClean carries full commercial general liability insurance. In the event that you believe AClean has caused damage to your property during the performance of services, you must:

  1. Notify AClean in writing (email or written letter) within 72 hours of service completion, describing the alleged damage in detail.
  2. Preserve any damaged items and allow AClean the opportunity to inspect the damage before any repair, disposal, or remediation is undertaken.
  3. Provide photographic evidence of the alleged damage and any supporting documentation regarding pre-existing condition (e.g., prior inspection reports, photographs).

Failure to provide timely notice as required above may prejudice ACLEAN's ability to investigate the claim and may limit or void ACLEAN's liability. AClean will respond to all damage claims in writing within five (5) business days of receipt and will work cooperatively to resolve legitimate claims fairly and promptly.

Important: Damage claims submitted more than 72 hours after service completion will not be accepted, as it is not possible to determine whether damage occurred during service or due to subsequent causes.

Indemnification

You agree to indemnify, defend, and hold harmless AClean, its owners, employees, subcontractors, and agents from and against any and all claims, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to:

Warranties & Disclaimers

AClean warrants that all services will be performed in a professional and workmanlike manner consistent with industry standards for exterior cleaning in British Columbia. This warranty is subject to and limited by the Satisfaction Guarantee set out in Section 8.

Except as expressly stated in these Terms, all services are provided on an "as is" and "as available" basis, without any further warranty, express or implied, including but not limited to implied warranties of fitness for a particular purpose or merchantable quality.

AClean does not warrant that cleaning services will remove all staining, discolouration, mineral deposits, biological growth, or other surface conditions that are permanently embedded in or bonded to the substrate. The results achievable by cleaning depend on the age, condition, and material of the surface being cleaned, which is outside ACLEAN's control.

Section 13

Governing Law & Disputes

13.1 Governing Law. These Terms and any dispute arising out of or in connection with them shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflicts of law principles.

13.2 Jurisdiction. The parties attorn to the exclusive jurisdiction of the courts of the Province of British Columbia, sitting in the City of Chilliwack or such other city as AClean designates, for the resolution of any dispute arising under these Terms.

13.3 Small Claims. Either party may bring a claim in the Civil Resolution Tribunal (CRT) of British Columbia for disputes up to $5,000.00 CAD, or the BC Small Claims Court for disputes up to $35,000.00 CAD, without waiving any rights under these Terms.

13.4 Informal Resolution. Before initiating any formal legal proceeding, both parties agree to make reasonable good-faith efforts to resolve any dispute through direct negotiation. AClean commits to responding to any written dispute notice within five (5) business days.

Changes to These Terms

AClean reserves the right to update or modify these Terms at any time. When changes are made, we will update the "Last Updated" date at the top of this page. Continued use of our services after any modification constitutes your acceptance of the revised Terms.

For services booked prior to a Terms update, the Terms in effect at the time of booking shall apply to that engagement, unless you expressly agree in writing to the updated Terms.

We recommend bookmarking this page and reviewing it periodically. Material changes will be communicated by email to Clients with active bookings where reasonably practicable.
